2018 Legislative Update - Week 1

The Utah State legislature just completed its first week of their session. Over the next 8 weeks or so we will be sending you regular updates so you know what they are doing and how it will affect you.
Two bills we are closely following are one hostile to the industry, HB 191 Carbon Monoxide Detector Repeal by Mark Wheatley (D) Salt Lake City, and one friendly to the industry, HB 30, Anti- Discrimination Amendments by Jim Dunnigan (R), Taylorsville. 
HB 191 – Carbon Monoxide Detector Repeal. We believe it’s a great idea for landlords to provide Carbon Monoxide detectors in residential rental housing. But since the landlord isn’t there to make sure the tenant doesn’t disable to remove them, we think the occupant of the property, whether a renter or the owner, should be the one legally responsible for providing and maintain the devices. In 2009, the state legislature overwhelmingly approved a bill that allowed cities to require carbon monoxide detectors to be installed and maintained by the occupant of residential properties. It was a good bill. But the Carbon Monoxide detector manufacturers and the news media want to force all landlords to provide them and be responsible to maintain them. We are open to compromise but want to protect landlords from liability when the tenant disables or removes these devices. 
HD 30 Anti-Discrimination Amendments. It is currently illegal to falsely claim a person has a service animal. In our business, many tenants want to have an “assistance animal”, which is not a service animal for a person with a disability, but assists with a disability nonetheless. This bill clarifies it is also illegal to falsely request an assistance animal, and we support this bill to send a message to the fraudsters that only legitimately disabled have access to service and companion animals. 
Below are some other bills we are tracking that we have not taken a position on and will be working with bill sponsors to find a compromise. We will have more to say on these bills next week:
HB 115: Bad Faith Demand Letters Concerning Americans with Disabilities Act by Rep. Norman Thurston 
Bill Summary: This bill enacts a cause of action for sending bad faith demand letters concerning the Americans with Disabilities Act.
